1. Introduction

These Terms of Service (“Terms”) govern your use of the website definetours.com(“the Website”) and all services provided by Define Tours Kalkan (“we,” “our,” or “us”), including but not limited to airport transfers, boat trips, car hire, activity bookings, and excursions.

By accessing our Website or making a booking, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Bookings & Reservations

All bookings are subject to availability. A booking is considered confirmed only after you receive a written confirmation from us via email or WhatsApp. We reserve the right to decline any booking at our sole discretion.

When making a booking, you must provide accurate and complete information, including but not limited to: full name, contact details, flight information, pickup/drop-off locations, dates, and number of passengers. We are not responsible for delays or service failures resulting from inaccurate information provided by you.

3. Pricing & Payment

All prices displayed on our Website are in British Pounds (GBP) or Euros (EUR) as indicated. Prices are subject to change without prior notice; however, once a booking is confirmed, the agreed price is locked in.

• Airport Transfers: Payment is collected on arrival. We accept cash (GBP, EUR, TRY) and card payments. No prepayment is required.
• Boat Trips & Activities: Payment is typically collected on the day of the activity. For private charters, a deposit may be requested to secure the booking.
• Car Hire: A security deposit may be required at the time of vehicle collection. Daily rates are as quoted, inclusive of insurance unless stated otherwise.

All prices include applicable taxes unless explicitly stated otherwise. Additional costs (e.g., entrance fees, meals not specified, personal expenses) are the responsibility of the customer.

4. Cancellation & Refund Policy

4.1 Airport Transfers

• Free cancellation up to 24 hours before the scheduled pickup time.
• Cancellations within 24 hours may be subject to a 50% charge of the quoted fare.
• No-shows (failure to meet the driver without prior notice) will be charged the full fare.

4.2 Boat Trips & Activities

• Free cancellation or rescheduling up to 24 hours before the activity start time.
• Cancellations within 24 hours may be subject to a 50% charge.
• In the event of adverse weather conditions or circumstances beyond our control, we will offer a full refund or alternative date at no extra cost.

4.3 Car Hire

• Free cancellation up to 48 hours before the rental start time.
• Late cancellations or no-shows may forfeit any deposit paid.

5. Flight Delays & Transfer Waiting Time

We monitor all incoming flights in real time. If your flight is delayed, your driver will adjust the pickup time accordingly at no extra charge. After landing, your driver will wait up to 60 minutes from the flight arrival time free of charge. Waiting time beyond 60 minutes may incur an additional charge of £15 per 30 minutes.

If you are delayed at baggage claim or passport control, please contact us via WhatsApp or phone as soon as possible so we can coordinate with your driver.

6. Vehicle & Boat Safety

All our vehicles and boats are fully licensed, regularly maintained, and insured in accordance with Turkish law. Our drivers and boat crews are qualified professionals. Child seats are available upon request at no extra charge for airport transfers (subject to availability — please request at the time of booking).

Passengers are required to wear seat belts in vehicles at all times. For boat trips, life jackets are provided and must be worn when instructed by the crew.

7. Car Hire Conditions

• Drivers must be at least 21 years oldand hold a valid driver’s licence for a minimum of 2 years.
• An international driving permit (IDP) is not required for most nationalities; a valid domestic licence is sufficient.
• The vehicle must be returned with the same level of fuel as at collection.
• Smoking is strictly prohibited in all rental vehicles. A cleaning fee of £100 will apply if this rule is violated.
• The renter is responsible for any traffic fines, toll charges, or parking penalties incurred during the rental period.
• In the event of an accident, you must contact us immediately. Do not move the vehicle or admit liability until authorised by our insurance provider.
• Off-road driving is prohibited unless explicitly authorised.

8. Activity Participation & Safety

Participation in our activities (including but not limited to quad biking, paragliding, scuba diving, jeep safari, horse riding, canoeing, sea kayaking, and water sports) is at your own risk. All activities are covered by personal and third-party liability insurance.

You must follow all safety instructions provided by our guides and instructors at all times. We reserve the right to refuse participation to any person who appears to be under the influence of alcohol or drugs, or who fails to comply with safety instructions, without refund.

Some activities have age, weight, or health restrictions. Please inform us of any medical conditions, disabilities, or special requirements at the time of booking so we can advise on suitability.

9. Limitation of Liability

To the fullest extent permitted by law, Define Tours Kalkan shall not be liable for any indirect, incidental, special, or consequential damages arising from or in connection with the use of our services, including but not limited to:

• Flight delays or missed connections.
• Loss of personal belongings during transfers, boat trips, or activities.
• Personal injury or accidents resulting from failure to follow safety instructions.
• Events beyond our reasonable control (force majeure), including but not limited to natural disasters, extreme weather, strikes, road closures, or government actions.

Our total liability for any claim arising from a booking shall not exceed the total amount paid by you for that specific service.

10. Website Use & Intellectual Property

All content on this Website — including text, images, logos, graphics, and design — is the property of Define Tours Kalkan or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or use any content from this Website for commercial purposes without our prior written consent.

You agree not to use the Website for any unlawful purpose or in violation of these Terms.

11. Third-Party Links

Our Website may contain links to third-party websites or services (e.g., Google Maps, TripAdvisor, WhatsApp). These links are provided for your convenience only. We do not endorse or assume responsibility for the content, privacy policies, or practices of any third-party sites.
